PIGMINT TERMS OF SERVICE

These Terms of Service ("Terms") are a binding agreement between you and Ripmint, Inc., a Delaware corporation, doing business as "Pigmint" ("Pigmint," "we," "us," "our"). Pigmint provides an online marketplace and digital reveal experience for collectible items such as trading cards (the "Service").
IMPORTANT NOTICE: ARBITRATION AND CLASS ACTION WAIVER
These Terms include an arbitration agreement and class action waiver in Section 19. It affects your legal rights. Please read it carefully.
1. Acceptance of Terms
By accessing or using the Service, you agree to these Terms and our policies referenced here (collectively, the "Policies"), including our Privacy Policy, Refund Policy, and Seller Guidelines. If you do not agree, do not use the Service.
We may update these Terms at any time. We will update the "Last updated" date. Your continued use after changes means you accept the updated Terms.
2. Eligibility
You may use the Service only if:
- a) you are at least 18 years old, and
- b) you have the legal capacity to enter into these Terms, and
- c) you are not prohibited from using the Service under applicable law.
We may restrict the Service by geography or user type at our discretion. You represent and warrant that the information you provide to us is accurate.
3. Account Registration and Security
You may need to create an account. You agree to:
- a) provide accurate, current, and complete information,
- b) maintain and promptly update account information,
- c) keep your credentials confidential, and
- d) notify us immediately of unauthorized access or use.
You are responsible for all activity on your account. We may suspend or terminate accounts that violate these Terms or create risk for the Service, users, or compliance obligations.
4. Definitions
"Buyer" means a user who purchases packs or items.
"Seller" means a user approved to list and sell packs or items.
"Pack" means a listing that provides a Buyer a defined quantity of physical collectible items (for example, trading cards) from a disclosed checklist, delivered after purchase.
"Checklist" means the list of possible items associated with a Pack listing, including quantities and any stated attributes (for example, set, treatment, condition standard).
"Allocation Rate" means a percentage or rate displayed on a listing that describes how frequently an item appears within a series or pool for that listing. Allocation Rates are informational and are not a guarantee of any individual outcome.
"Price References" means informational estimates derived from third-party or market data sources (for example, marketplace data). Price References are not guaranteed and may change.
"Hold Window" means the period after purchase during which shipment may be delayed to enable bundling with additional purchases from the same Seller, if enabled.
"Ship Now" means a Buyer request to begin shipment before the Hold Window ends, if available.
5. Marketplace Model and Our Role
Pigmint is a marketplace and experience platform. Unless we explicitly state otherwise, Pigmint is not the Seller of items listed by third-party Sellers. Sellers are responsible for listing accuracy, inventory, fulfillment, and compliance with law.
We may provide tools, rules, and mediation to help resolve disputes. We do not guarantee any particular dispute outcome.
6. Pack Purchases, Reveals, and Key Disclosures
6.1 What you are buying
When you purchase a Pack, you are purchasing physical collectible items from a Seller. The on-site "reveal" (sometimes called a "rip") is a digital experience that displays the items allocated to your purchase. The reveal does not create, change, or determine ownership. It is a presentation layer for the purchased goods.
6.2 Checklist and transparency
Pack listings must disclose a Checklist. We may show additional informational disclosures such as Allocation Rates, tier composition, quantities remaining, or similar transparency tools.
Allocation Rates and tier composition describe the listing as a whole. They do not guarantee what any individual purchase will contain.
6.3 Price References and value disclaimer
We may display Price References. You acknowledge and agree:
- a) Price References are informational estimates and may be inaccurate, incomplete, or outdated,
- b) Price References may change at any time,
- c) the market value of the items you receive may be lower than the Pack price, and
- d) neither Pigmint nor Sellers guarantee any particular value, profit, or outcome.
Purchases on Pigmint are for collectible items, not entry into a contest, sweepstakes, raffle, lottery, or prize game.
6.4 Errors and corrections
If a verified technical error occurs (for example, listing inconsistency, duplicated allocation, missing inventory, or system malfunction), we may correct the error by:
- a) requiring Seller to deliver the correct item(s),
- b) requiring Seller to deliver a comparable substitute approved by the Buyer, or
- c) refunding or canceling the purchase consistent with our Refund Policy.
7. Condition Standard
Pokemon listings on Pigmint use TCGPlayer condition standards. The condition shown on the listing at the time of purchase governs, and any Pokemon condition dispute is judged using TCGPlayer's criteria for that listed condition. TCGPlayer's marketplace condition labels include Near Mint, Lightly Played, Moderately Played, Heavily Played, and Damaged.
Sorcery cards on Pigmint are NM+ only. Sellers may not replace these publisher-specific condition standards with custom grading language or a private condition rubric.

8. Shipping, Hold Window, and "Ship Now"
8.1 Default Hold Window
Unless a listing states otherwise, the default Hold Window is 2 days. During the Hold Window, we may delay shipment to allow you to bundle additional purchases from the same Seller into one shipment.
8.2 Ship Now
If available, you may request "Ship Now." When you request Ship Now, the Seller is expected to ship the next business day. Ship Now may limit further bundling for that order.
8.3 Tracking and packaging
Sellers must ship using tracked shipping labels and package items appropriately to prevent damage in transit. Sellers are responsible for ensuring the shipment address is used as provided in the order.
8.4 Delivery status
For purposes of these Terms, "Delivered" means the carrier tracking indicates delivery to the shipping address.
9. Fees and Payments
9.1 Platform commission
Pigmint charges Sellers a standard 10% seller fee in the form of platform commission on the item price for completed sales. Unless we specify otherwise, the seller fee is calculated on the item subtotal excluding taxes, shipping, and processor fees.
Pigmint may offer promotional programs with different seller fee rates for eligible sellers, including the Founding Seller Program. The Founding Seller Program changes only the seller fee or platform commission. It does not include, cap, or waive payment processing fees, which remain separate under Section 9.2. Promotional seller fee rates are displayed on the Pricing page and/or in the seller dashboard and are applied automatically when the listed criteria are met.
9.2 Payment processing fees
Payments are processed by Stripe or other third-party payment processors ("Payment Processors"). Payment processing fees are charged at the rates set by the Payment Processor. We do not add an additional markup to processor fees.
9.3 Payment Processor terms
Your use of the Service may require you to agree to Payment Processor terms. Sellers may be required to connect a Stripe account and complete identity verification to receive payouts.
9.4 Holds, reserves, and payout eligibility
To reduce fraud and enable Buyer dispute windows, Seller proceeds are not immediately payable upon purchase. Payouts become eligible 2 days after an order is marked Delivered. Once eligible, Pigmint may move those funds to the Seller's connected Stripe balance. Eligibility does not guarantee immediate transfer. Pigmint and/or Payment Processors may delay payouts due to disputes, chargebacks, risk reviews, verification requirements, refunds, or suspected policy violations.
We may place holds or reserves to cover refunds, chargebacks, claims, or other liabilities. We may withhold amounts reasonably necessary to address risk.
9.5 Withdrawals
After funds reach a Seller's Stripe balance, the Seller controls when to withdraw them using Stripe's payout tools. Withdrawal timing and any payout-method fees are determined by Stripe and the payout method selected by the Seller. Pigmint does not guarantee that withdrawals will be free or instantaneous.
10. Taxes
Sellers are responsible for determining and complying with all applicable tax obligations, including any sales tax, VAT, income tax, or other taxes, and any reporting obligations. We may collect or remit certain taxes where required by law or Payment Processor policies.
11. Prohibited Conduct
You agree not to:
- a) list, sell, or ship counterfeit items, stolen items, or items you do not own,
- b) misrepresent item authenticity, condition, treatment, or listing details,
- c) manipulate or attempt to manipulate listing disclosures, Allocation Rates, inventory, or platform mechanics,
- d) use the Service for fraud, money laundering, or illegal activity,
- e) harass, threaten, or abuse others,
- f) scrape, crawl, reverse engineer, or interfere with the Service,
- g) circumvent the platform to transact off-site for items discovered through Pigmint,
- h) market or frame listings as gambling, contests, lotteries, raffles, sweepstakes, prize games, or "guaranteed profit."
We may remove listings, suspend accounts, withhold payouts, and cooperate with law enforcement if we believe prohibited conduct occurred.
12. Refunds, Returns, and Disputes
12.1 Refund Policy applies
Refunds and returns are governed by our Refund Policy. Pack outcomes alone are not a valid basis for a refund if the delivered items match the listing's Checklist and condition standard.
For condition disputes, the applicable standard is the condition shown on the listing at purchase time: TCGPlayer criteria for Pokemon and NM+ for Sorcery.
12.2 Buyer dispute window
Buyers must contact support@pigmint.gg within 7 days after delivery to report an issue. After that window, we may decline to provide remedies to the extent permitted by law.
12.3 Evidence requirements
To evaluate disputes, we may require evidence including:
- a) clear photos of the item(s) front and back,
- b) photos of packaging (outer box/envelope), inner protection, and shipping label,
- c) a short unboxing video if damage or missing items are alleged (if available),
- d) screenshots of the listing at time of purchase (if applicable),
- e) any third-party authentication or grading documentation if relevant.
We may deny claims that lack sufficient evidence, are inconsistent with listing disclosures, or show signs of fraud.
12.4 Returns required for "not as described"
For items that are "not as described" and are eligible for a return under our Refund Policy, returns are required unless we explicitly waive the return in writing. Returned items must be in the same condition as received. We may require tracked return shipping.
12.5 Chargebacks
You agree to contact support@pigmint.gg and attempt resolution before initiating a chargeback, unless prohibited by law. Excessive chargebacks may result in account suspension or termination. We may withhold Seller payouts during chargeback investigations.
12.6 Support response time
We aim to respond to support inquiries within 48 hours, but we do not guarantee response times.
Promotional Codes and Truffles
Pigmint may offer promotional codes, partner offers, and reward credits from time to time. Promotional codes may be limited by date, eligibility, purchase history, order type, product category, geography, account status, or other conditions disclosed at the time of the offer.
“Truffles” are promotional reward credits offered by Pigmint. Truffles are not purchased, have no cash value, are not property, are not transferable, and may not be redeemed for cash. Unless otherwise stated, each Truffle may be redeemed for $0.10 off an eligible future purchase on Pigmint.
Truffles may only be applied to eligible item subtotal and may not be applied to taxes, shipping, processing fees, tips, or other excluded charges. Pigmint may set or change minimums, caps, expiration rules, and eligibility rules for Truffles or promotional codes at any time, subject to applicable law.
Pigmint may revoke, reverse, cancel, withhold, or adjust promotional code benefits or Truffles in cases of refund, chargeback, fraud, abuse, error, misuse, suspected policy violations, or other circumstances where Pigmint determines that a reward was granted improperly or should no longer apply.
If Truffles associated with an order are reversed after the user has already spent them, the user's account may reflect a negative Truffle balance. Users with negative Truffle balances may be restricted from redeeming additional Truffles until the balance is restored to zero or above.
Promotional codes and Truffles may be modified, suspended, or discontinued at any time.
13. Seller Obligations
If you are a Seller, you agree that:
- a) you have the right to sell and ship the items you list,
- b) listings are accurate and complete, including Checklist, quantities, and applicable condition standard,
- c) you comply with shipping obligations and timeframes,
- d) you comply with platform policies and applicable law,
- e) you will not use deceptive marketing or prohibited gambling language,
- f) you will cooperate with dispute investigations and provide evidence when requested.
We may require additional verification, documentation, onboarding, or quality controls as a condition of selling.
14. Intellectual Property
14.1 Pigmint IP
The Service and our trademarks, logos, designs, software, and other content are owned by Pigmint or our licensors and protected by law. You may not use our branding without written permission.
14.2 Third-party IP
Card names, game names, artwork, and set names may be owned by third parties. Pigmint is not affiliated with or endorsed by any publisher unless explicitly stated.
14.3 User Content license
You grant Pigmint a worldwide, non-exclusive, royalty-free license to host, reproduce, display, distribute, and modify your User Content solely to operate, improve, and promote the Service. You represent you have the rights to grant this license.
15. Content Removal and Enforcement
We may remove listings or content for any reason, including policy violations, suspected fraud, safety, legal compliance, or risk management. We may suspend or terminate accounts as described in Section 20.
16. Third-Party Services and Data
The Service may rely on third-party services and data sources (including Price References). We do not control third-party services and do not guarantee availability, accuracy, or suitability.
17. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, PIGMINT DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
WITHOUT LIMITING THE ABOVE, PIGMINT DOES NOT WARRANT:
- a) uninterrupted or error-free operation,
- b) that Price References are accurate or current,
- c) that any Pack purchase will have any particular market value,
- d) that Sellers will perform without issue (though we enforce policies and provide remedies where applicable).
18. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- a) PIGMINT WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION.
- b) PIGMINT'S TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF (i) THE AMOUNT OF FEES YOU PAID TO PIGMINT IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (ii) $100.
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
19. Dispute Resolution, Arbitration, and Class Action Waiver
19.1 Informal resolution first
Before filing a claim, you agree to contact us at support@pigmint.gg and attempt informal resolution for at least 30 days. Include your name, account email, a description of the issue, and the relief requested.
19.2 Binding arbitration
Except for claims that may be brought in small claims court and claims seeking injunctive relief for intellectual property or unauthorized access, you and Pigmint agree to resolve disputes by binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules.
19.3 Arbitration location and procedure
Arbitration will be conducted by video, phone, or based on written submissions unless the arbitrator determines an in-person hearing is necessary. If an in-person hearing is necessary, it will take place in Travis County, Texas, unless the arbitrator determines another location is required by law.
19.4 Class action waiver
YOU AND PIGMINT AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING.
19.5 Mass filings
If 25 or more similar arbitration demands are asserted against Pigmint by the same or coordinated counsel or parties, you agree that the parties will cooperate in good faith to implement a batching process, including selecting a limited number of cases to proceed first as bellwethers. The remaining matters will be stayed while the bellwethers are arbitrated. If the parties cannot agree on batching, the arbitrator will decide the process.
19.6 Opt-out
You may opt out of arbitration by sending an email to support@pigmint.gg within 30 days of creating your account, with subject line "Arbitration Opt-Out," and include your name and the email associated with your account. Opting out does not affect other Terms.
19.7 Governing law
These Terms are governed by Delaware law, excluding conflict of laws principles, except that the Federal Arbitration Act governs the interpretation and enforcement of this arbitration agreement.
20. Suspension and Termination
We may suspend or terminate your account, listings, or access to the Service at any time if:
- a) you violate these Terms or Policies,
- b) we suspect fraud or illegal activity,
- c) your activity creates risk for the Service, other users, or compliance obligations, or
- d) we are required to do so by law or Payment Processor rules.
Upon termination, you may lose access to your account. We may process pending orders, refunds, holds, or disputes consistent with these Terms and the Policies.
21. Communications
By using the Service, you consent to receive communications electronically (email, in-app notifications). These communications may include transactional notices, policy updates, and legally required notices.
